General Policies of Use

Welcome to Coomune,

1. Policy Objective

  • Establish clear guidelines on what is or is not permitted in the use of the Coomune platform.
  • Guarantee freedom of expression with social, civil, and legal responsibility.
  • Define the roles and limits between users, moderators, creators, and the Coomune platform.
  • Base the principles of digital coexistence on the Portuguese Constitution, GDPR, and DSA.

2. Application and Scope

  • Applies to all users, moderators, guests, visitors, and entities that interact with the platform, directly or through integrations.
  • Applies to all {logo} environments: public or private communities, messages, comments, profiles, posts, images, and documents.

3. Guiding Principles

  • Freedom of expression with responsibility.
  • Human dignity as a non-negotiable value.
  • Transparency in moderation actions.
  • Community participation in decisions and reports.
  • Respect for the legislation of Portugal and the European Union.
  • Non-discrimination and combating hate speech.

4. Permitted Content

  • Personal opinions, even if controversial, provided they are not offensive or illegal.
  • Artistic, cultural, educational, or informative content.
  • Political, social, and institutional criticism within legal limits.
  • Humor, satire, and irony not directed at the degradation of vulnerable groups.

5. Prohibited Content

5.1. Illegal Content:

  • Apology of crimes (terrorism, pedophilia, trafficking, etc.).
  • Disclosure of intimate images without consent (revenge porn).
  • Violation of copyrights or intellectual property.
  • Incitement to self-harm or suicide.

5.2. Dangerous Content:

  • Disinformation that puts lives at risk (e.g., public health, catastrophes).
  • Call for lynching, persecution, or violence.

5.3. Unethical or Abusive Content:

  • Sexual or moral harassment.
  • Systematic bullying.
  • Hate speech based on race, color, sexual orientation, nationality, religion, disability, or health status.

6. Communication Standards

  • Communication must prioritize civility and good faith.
  • The use of intentionally degrading, humiliating, or provocative language is not permitted.
  • The use of emojis, memes, and ironies must respect context and limits of common sense.

7. Identity and Authenticity

  • Profiles must represent real people or authorized organizations.
  • It is prohibited to create multiple accounts to deceive, manipulate, or simulate interactions.
  • Impersonating third parties, including public figures, constitutes a serious violation.

8. Privacy and Personal Data

  • It is prohibited to disclose any personal data of third parties without consent.
  • The publication of private documents, photos, videos, messages, or screenshots without authorization will not be tolerated.
  • The platform adopts compliance measures with the GDPR and Law 58/2019.

9. Spam, Manipulation, and Bots

  • The use of scripts, robots, or automated tools to generate interactions is prohibited.
  • The artificial creation of likes, followers, or engagement for commercial or misleading purposes is prohibited.
  • Sending repetitive content, suspicious links, or out-of-context propaganda will be treated as spam.

10. Operating Entity and Legal Jurisdiction

  • Must follow high standards of impartiality and transparency.
  • Are obliged to respect these Policies and applicable laws.
  • Abuses of power, unjustified censorship, or persecution may be reported to the platform.
  • Creators may define their own rules provided they do not conflict with these guidelines.

11. Reporting System and Community Arbitration

  • Any user may flag abusive or illegal content via the ⚠️ icon.
  • Content with a high number of alerts may be analyzed by random community arbitrators, who act as independent, temporary, and rotating jurors.
  • Arbitrators have deadlines, criteria, and impartiality required by designation.
  • The system allows for rebuttal and defense by the post's author.

12. Administrative Measures and Sanctions

  • Educational warning.
  • Content removal.
  • Suspension of functionalities.
  • Restriction of visibility.
  • Temporary or permanent suspension.
  • IP, device, or recidivist account blocking.
  • Communication of criminal conduct to competent authorities.

13. Appeals and Review of Sanctions

  • All disciplinary measures will be notified with justification.
  • The user will have a channel to appeal and request a new analysis.
  • The review will be conducted by an instance different from the one that applied the sanction.
  • Unjustified decisions may be reversed and content restored.

14. Account Deletion and Voluntary Withdrawal

  • The user may close their account at any time.
  • Deletion may be automatic after 24 months of inactivity.
  • Upon deleting the account, the user may request the total elimination of their data, as guaranteed by Art. 17 of the GDPR (right to erasure).

15. Updates and Policy Effectiveness

  • This policy may be updated at any time to meet legal, technical, or social changes.
  • Users will be informed with reasonable advance notice.
  • Continued use of the platform after an update implies tacit acceptance.
  • All previous versions will be archived for transparency purposes.

16. Jurisdiction and Applicable Law

  • These General Use Policies are governed by the laws of the Portuguese Republic and subsidiarily by European Union Law.
  • In case of disputes, the competent jurisdiction will be the District of Leiria, save for exceptions provided by law.
